1. Acceptance of Terms
These Terms of Service ("Terms") govern access to and use of the GetIntakes platform, websites, and APIs provided by GetIntakes ("Company", "we", "us"). By registering for an account, accessing our applications, or purchasing a subscription, you agree to be bound by these Terms on behalf of yourself and the organization you represent.
2. Description of the Service
GetIntakes provides automated client intake and administrative workflow routing software. The service facilitates after-hours automated response triage, intake questionnaire distribution, appointment scheduling synchronization, and payment hold authorizations via integrations with third-party payment gateways and electronic medical records (EMRs).
3. Clinical Disclaimer — Not Medical Advice
IMPORTANT: GetIntakes software, including automated triage prompts, conversational agents, and photo triage features, is strictly administrative and informational in nature. The software does not provide medical advice, diagnostic evaluations, or clinical determinations. All clinical judgment, medical candidacy determinations, and patient care decisions remain the exclusive responsibility of licensed healthcare providers.
4. Client Responsibilities & EMR Credentials
Clients are responsible for maintaining the confidentiality of their credentials and administrative access. You represent and warrant that you possess all necessary patient authorizations and legal rights to transmit data to and from third-party systems, including EMR software and billing providers.
5. Subscriptions, Fees & Billing
Access to GetIntakes is provided on a recurring subscription basis (monthly or annual billing) as specified in your order form. Subscriptions automatically renew unless canceled in accordance with platform policies prior to the renewal date. All fees are exclusive of applicable taxes.
6. Intellectual Property & Acceptable Use
GetIntakes retains all rights, title, and interest in and to the platform software, algorithms, interfaces, and proprietary documentation. You agree not to reverse engineer, decompile, resell, or distribute the platform, nor use it in violation of any applicable healthcare or consumer privacy laws.
7. Limitation of Liability
To the maximum extent permitted by applicable law, GetIntakes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruptions resulting from system outages or third-party API disruptions. Total aggregate liability under these terms shall not exceed the amounts paid by the client in the three (3) months preceding the claim.
